US Reaches $2.925 Million Settlement Related to the 2012 Horsethief Canyon Fire

CHEYENNE — United States Attorney Christopher A. “Kip” Crofts announced today that a settlement has been reached with James Anderson, requiring him to pay $2.925 million in damages resulting from the Horsethief Canyon Fire that began on September 8, 2012, near Jackson.

The fire started approximately five miles south of Jackson, and spread to the Little Horsethief Canyon area, burning approximately 3,373 acres. Fire investigation confirmed the blaze originated near a metal burn barrel located on Mr. Anderson’s property.

The barrel, which Mr. Anderson had used to burn debris on the morning of the fire and then left unattended, was rusted through at the base creating several holes that allowed ash to escape, igniting dry vegetation and spreading out of control to the surrounding area.

The United States advised Mr. Anderson of its intent to file a civil action for negligence, seeking recovery of fire suppression costs and related damages incurred by the Forest Service and its federal and state agency partners. Today’s settlement avoids further litigation.

The settlement amount, which includes insurance payments, will be shared among the various federal and state agencies involved according to a cost share agreement.

“We are pleased to have obtained a substantial recovery of costs associated with fighting this fire,” said United States Attorney Christopher “Kip” Crofts. “While nothing can undo the damage that was done to the forest, this settlement sends a message that we are serious about holding those who cause fires accountable.”

The United States was represented in this matter by Assistant United States Attorney Mark Klaassen of the U.S. Attorney’s Office in Cheyenne. The United States Attorney’s Office also acknowledges the cooperation and teamwork demonstrated by the United States Forest Service and United States Department of Agriculture, Office of General Counsel in the course of this investigation and settlement.
